BRIEF ON THE MINISTRY

The Ministry of Justice was established in 1976 sequel to the creation of Ogun State, and at its inception commenced operations at Ita-Eko, Abeokuta before it relocated to the Mini-Secretariat, Oke-Ilewo, Abeokuta.

 

The Ministry initially commenced with the Departments of Public Prosecutions, Civil Litigation and Advisory Services, Legislative Drafting, Administrator-General and Public Trustee, with the Department of Finance and Administration complementing the Legal Departments. In 2004 and 2008 respectively, as the scope of the Ministry expanded, the Departments of Citizens Rights and Commercial Services were added.

 

A Sub-department in the Ministry, known as Boundary Settlement headed by a Counsel was ceded to the office of the Deputy Governor during the tenure of Navy Captain Oladeinde Joseph as the Military Administrator of Ogun State and Alhaji Adeolu Balogun as the Deputy.

 

The Laws of Ogun State of Nigeria came in to force on the 31stday of December, 1978 together with subsidiary legislations. The laws contained in seven (7) volumes were reviewed in 2006 under the supervision of the Ministry of Justice.  It is instructive to note that before the enactment of the Ogun State Laws in 1978, the Laws of the Western Region of Nigeria, 1959, were in operation. The Ministry in 2014 adopted Information Technology software for the record and update of Supreme Court judgments. The Ministry remains the custodian of published Gazettes of the State.

Duties

Duties

    1. Instituting, handling and concluding Civil cases on behalf of the State Government, its Ministries, Parastatals, Corporations and Officers, the Local Government and their officers in the Magistrate Courts, State High Courts or the Federal High Courts.
    2. Defending the State Government, its Ministries, Parastatals, Corporations and Officers, the Local Government and their officers and the Police in Civil cases instituted against them in Magistrate Courts, the State High Courts or the Federal High Courts.
    3. Handling Appeals arising from (a) or (b) above in High Courts (when appeals emanate from a Magistrate Court), the court of Appeal (when it emanates from the High Court) or Supreme Court (when it emanates from the Court of Appeal).
    4. Rendering Legal Advice to the State Government, its Ministries, Parastatals and Corporations, the Local Governments and the Police in both administrative and legal matters.
    5. Representing the State Government, its Ministries, and Parastatals in out of Court Settlement Cases.

DEPARTMENT OF CITIZENS’ RIGHTS

Duties

  1. This Department offers free Legal Services, appears in courts and police stations on behalf of indigent citizens, as well as, offers human rights education, advice and counsel at no fee to the poor and the disadvantaged. The Department also conducts mediation amongst aggrieved parties.
  2. In the same vein, this Department is charged with the primary responsibility of ensuring that the legal and human right problems of the members of the public (particularly the indigents) receive prompt attention and solution by State Government at no fee. It also ensures that irrespective of their means, residents in Ogun State have access to justice.

DEPARTMENT OF COMMERCIAL SERVICES

Duties

  1. Preparation and vetting of relevant Commercial documents on behalf of the Government and its Agencies including Agreements/Memoranda of Understanding with Contracting Parties.

DEPARTMENT OF ADMINISTRATOR-GENERAL AND PUBLIC TRUSTEE

Duties

  1. Processing Letters of Administration for families of persons who died intestate, as well as, helping in solving problems that may arise amongst beneficiaries.
  2. The Department also deals with all issues revolving around probate matters
  3. Mediation/Settlement of disputes relating to Estate matters.
  4. Appearing in Court for suits arising from Estate matters.
  5. Processing of death gratuities and pension of persons who died intestate.

Duties

  1. The Department is primarily responsible for the review of the laws of Ogun State.
  2. The Department co-ordinates training and re-training of Law Officers and Administrative Staff in order to enhance their performance.
  3. The department is in charge of the Law Library, the Law Library   Pavilion Research Facility as well as purchase of books for the Library.
